1.     ABOUT THE SCHOOL

Kenya School of Law is a premier academic public institution mandated under the Kenya School of Law Act No. 26 of 2012 to deal with practical teaching and training in the area of law for and on behalf of the Government of Kenya. The School organises and conducts training for the acquisition and enhancement of legal knowledge and professional skills development not only for legal professionals, but also for other professionals.

 

2.     ABOUT THE COURSE

The Data Protection Act, No. 24 of 2019, came into effect on 25th November, 2019.  The Act is meant to give effect to Article 31(c) and (d) of the Constitution of Kenya 2010 on the right to privacy.  In addition to establishing the Office of the Data Protection Commissioner, the Act makes provision for the regulation of the processing of personal data.  It provides for the rights of data subjects and obligations of data controllers and processors.  The three data protection regulations seek to safeguard the processing of personal data, provide for the rights of data subjects and the obligations of data controllers and processors.

 

Apart from the threat of costly litigation and reputational risk, organization’s face penalties of up to KShs 5 million and prison terms of up to ten years for non compliance. It is therefore crucial for organizations to understand their organizational responsibilities and steps that they need to take to comply with law and regulations by training key staff in the organizations.

3.     COURSE CONTENT

Among the topics to be covered are;

ü  An in-depth study of the current data law, policies and regulations in Kenya

ü  Key organizational responsibilities for organizations and other players

ü  Steps to be taken to ensure compliance

ü  Recent case law and complaints to the Office of the data commissioner

ü  A critical examination of the adequacy of current laws in Kenya

ü  Data Protection and Alternative Dispute Resolution

ü  Data Protection Impact assessment

ü  Global developments in data protection

ü  Opportunities and challenges for practitioners

 

4.     COURSE DELIVERY

The training will be conducted by a highly experienced team of seasoned data protection experts who are practitioners and professors in the field. The training will be conducted through interactive lectures, assignments and plenary discussions to ensure that it is participatory, interactive and practical.

 

5.     INTENDED PARTICIPANTS

The course is open to both legal and non-legal professionals.  It is particularly intended for:

      i.         Legal professionals and other data protection consultants, to be equipped with the relevant practical knowledge in order to advise their clients appropriately on data protection.

     ii.         Administrators, practitioners and government officials, both national and county, who are responsible for ensuring their organisations, businesses, corporations, and institutions comply with data protection laws. 

   iii.         Judicial officers, officials from the Office of the Data Protection Commissioner and law enforcement officers, being Officers tasked with the responsibility of interpreting and enforcing the data protection laws.

   iv.         Academicians and researchers on data protection.

     v.         Representatives of institutions, professional and regulatory bodies associated with data protection. 

 

6.     CERTIFICATION AND EVALUATION

A certificate will be issued to the participant who attends the entire course.

Those who wish to acquire the 3 CPD points will separately pay the LSK an additional sum of 1,000/= (payable during the training).

Registration for the Course is by logging to https://services.ksl.ac.ke/web/signup and signing up (for those without account) or signing in for those who have already opened an account. The system will generate a proforma invoice.
